I have heard this excuse countless times. No one can lose paperwork that much. I am now convinced that it is a lie. But, why would a lender blatantly lie like that?

In my opinion, they do that to make up for their failings. See, most loan modification and short sale departments are stretched to the max.

The employees are overworked and underpaid. Everyone just gets into the mindset of not caring. They have to deal with angry people every day.

The people are understandably angry and they want some answers. But, because nothing it getting done, the employees feel bad. But, rather than tell the customer what is really happening, they make something up.

No one wants to tell someone that nothing has happened on the file in several months. It will make that person even angrier. It could even start lawsuits against the lender.

It is much easier to tell them that their paperwork got lost somehow. It they tell them that, they will think it is a legitimate excuse and refax the paperwork.

Loudoun to Winchester VA – Yes, many people think they can negotiate with the lender. But, some of them don’t have the skills necessary to be successful.

Here are a few of the things someone needs before they can negotiate a short sale.

They must have the ability to understand HUD-1 Closing Statements. The lenders will want a copy of the closing statement, also call a HUD-1.

Most people in the lender’s short sale departments are very familiar with HUD-1s. The person negotiating with you will need to answer any questions they have about the HUD and know how to make changes to it.

They must know the short sale seller’s rights. Most short sale transactions fall under certain guidelines. The lenders don’t always like to follow those guidelines.

They might ask the seller to accept a promissory note when the guidelines don’t require that. You could be stuck repaying thousands of dollars unnecessarily.

Make sure the person negotiating on your behalf has a complete understanding of your rights.

They must know how short sale negotiators think. Short sale negotiators don’t just approve every short sale.

There is a process they must follow before approving or rejecting a short sale offer. If the person doesn’t understand then they won’t be able to work your file thru the process to receive an approval. Thinking about a short sale?

Loudoun to Winchester VA – We recently gave a couple of common reasons that short sales fail. Today, we will go thru a few more reasons.

(To recap, here were the reasons we put in our previous blog post. Reason #1: The sales price is lower than the lender wants. The lender thinks the home is worth more than it is selling for and won’t approve the short sale unless the price is for the value they have.

Reason #2: The tenant doesn’t allow the home to be showed. Many tenants do not want the home to be shown to buyers because they will have to move before it sells.)

Reason #3: Your realtor never followed up with the lender. Short sale negotiators are not in a rush. They don’t get paid by the file.

They also make the rules. They will issue ultimatums. “Get me this document by Tuesday. If you don’t, then I will cancel the short sale process.”

Restarting the short sale process will set you back 30-60 days. If your agent doesn’t follow up on the process regularly and quickly respond to requests, then your short sale may be canceled.

Reason #4: Your realtor didn’t keep their paperwork organized. Lenders want correct paperwork that is properly filled out. They want everything organized.

Most short sale departments are a bureaucracy. They have checklists to fill out, forms to check, and other things to check.

If your agent is not organized, then they won’t be able to give them the correct paperwork. They might lose paperwork and have to hunt down replacements.

This takes time and slows down the process. So, be sure you hire an organized, competent agent to help you with your short sale. Thinking about a short sale?

Loudoun to Winchester VA – The Stop Foreclosure Institute recently received a question from David. Here was his question.

“My lender ******** Bank verbally told me that my short sale was approved. However, now they are now telling me that Fannie Mae did not approve the sale.

They gave me an option to pay $3,000 upfront and to agree to pay off deficiency. I just cannot afford this option. The pay off amount on the mortgage is $122,000.

The buyer is offering $99,000. The bank’s appraiser said the house is worth $92,000. The Buyer has been waiting to buy the house for 11 months.

What the bank is telling my just doesn’t make sense. Any suggestions would be greatly appreciated. David.”

Here was our answer: David, I think your lender is lying to you. We have done a lot of short sales on Fannie Mae Loans. Here is something you may not know.

Your lender does not own your loan. They do not make the ultimate decision on what happens. Fannie Mae owns your loan.

That means that Fannie Mae makes the ultimate decision on whether or not to approve your short sale. Here is why this matters. Fannie Mae does not normally ask for deficiencies or cash from a short sale seller.

They do when the seller is strategically defaulting on their mortgage. But, most people short sale their house because they are having financial problems. If your lender persists, then you might want to contact Fannie Mae directly.

Or contact your Congressperson or Senator. Let them know that you think your lender is lying to you. Fannie Mae will find out what is happening and hopefully let you walk away with no deficiency or any cash out of pocket. Thinking about a short sale?

Loudoun to Winchester VA – The Stop Foreclosure Institute recently received a question from Katie. Here was her question.

I am an agent and I am helping someone short sell their house. X Lender (to remain unnamed) claims that they have sent a short sale package to the seller a couple of times.

But, they haven’t because my customer has never received anything. What can I do? They won’t start the short sale process until they receive the filled out package back from the seller. Katie.”

Here was our recommendation to Katie. Katie, you need to find out who owns the loan. Most likely it isn’t X Lender.

Then, tell the lender representative person that you will contact the loan owner direct and let them know about their incompetence.

As an example, we recently told a negotiator at a large nationwide lender that we would contact all the VFW posts about their incompetence on a VA short sale.

Their incompetence was causing the VA loan program to lose money. We threatened to tell America's Veterans how this lender was wasting their money.

We even put together a press release. What did that negotiator do? She got the short sale approved ASAP. This lender had been dragging their feet for almost two months before that.

We were able to get another large national lender to start working on an FHA file right away, when we reminded about a 5 day turnaround requirement that is in the FHA short sale guidelines.

The basis for contacting the loan owner is that you are holding the servicer accountable. Don't kid yourself, it works. The people who stand to lose money are going to be angry that the lenders do such a lousy job. Thinking about a short sale?

Loudoun to Winchester VA – Many buyers will ask what your bottom line is. They know that they can usually negotiate a home seller down to an even lower price.

Don't fall for it. You've already made the first move by setting a price for your home. Tell the buyers that you need to think it over and get back to them.

Then, ask them what they like about your home. If they tell you, then you can determine their motivation to buy your home. After that, ask them what they are thinking of offering on your home.

The reason this rule is so important is that in some negotiations you may offer more at the beginning than the other party is willing to accept. Here is an example of this.

A person I know was trying to buy something. He had a price in mind that he was willing to pay. He thought the best price he could get was $1,500, but he was willing to pay up to $2,000.

He asked the seller what he wanted for the item. The seller responded that he didn't know what he wanted. He offered the seller $1,500 and the seller accepted it.

Later on he learned that the seller was desperate. The seller had a price in mind of $800 to $1,000. If the seller had mentioned an opening price first, then he would have saved $500! Instead the seller made an extra $500.

Loudoun to Winchester VA – This is the worst sin of negotiating. Don't tell the buyer's or their agent your life's story.

What do you think would pop into a buyer's head if they heard this out of a seller's mouth? "We must sell the home because it is in foreclosure and if we don't sell it be June 23rd, then the bank will foreclose on it."

Immediately they will think, "I wonder what they owe on the house. If it doesn't sell they will have a foreclosure. The sellers probably just want to get what they owe on the home so they can avoid foreclosure."

This is an extreme example, but it shows you how a simple slip of the tongue could cause a seller to lose a large amount of their hard earned equity.

A seller facing foreclosure in that situation might be desperate enough to "get out" with none of their equity just to avoid foreclosure.

But, what if they buyer was willing to pay the market value for the home? That seller just lost all their equity! When a buyer asks why you are selling answer them without giving away any extra information.

You could say, "Oh, we would like to move to a smaller home." You don't need to say much more than that. And don't tell them you must sell by a certain date to avoid foreclosure!

Loudoun to Winchester VA – If you get annoyed at your bank, then here are a few methods you can use to let the world know about your lender's failings.

One technique is a rip off report. Just put all the information onto www.ripoffreport.com. Just be sure to detail stuff that will hurt them.

You will want to put the CEO’s name into your report. You can also put down keywords like "Lender Name Loan." When someone searches Google for your lender’s name and loan, your post might just show up.

Don't talk about your lender only. Target the keywords that bring them business.

Another place to file your complaints is on your review for your local Lender on Google Maps. Lots of consumers search for a bank location on Google Maps. They will see the reviews when they pull them up.

One other technique that would be great is Wikipedia. I don't have enough time to figure out how Wikipedia works, but that is an idea for anyone who wants to try it out. Thinking about a short sale?

Loudoun to Winchester VA – A short sale is the best option to erase upside down mortgage debt. A homeowner can often erase hundreds of thousands of dollars in debt.

I assume that you are looking to short sale for the following reasons.

1. Debt Reduction. You want to short sale and wipe out the upside down debt. You can’t afford or don’t want to repay the upside down debt.

2. You are willing to suffer the resulting credit damage a short sale will bring. Part of your rational is that the credit damage will be well worth the resulting reduction in debt.

If you are going to suffer the credit damage, then you might as well wipe out the rest of your debt at the same time. Make sense?

Here are a few debts you can erase at the same time when you are short selling your house.

* Credit card debts. You can often re-negotiate better terms on your credit card debts. An interest rate reduction from 18% to 10% will make a huge difference on your monthly payments.

You can even just go “cold turkey” on these debts and just stop paying them at all. Many of them will settle with you for as low as 50% of the balance owed.

If you wait for 6 months, then you can sometimes settle for even less than 50%.

* Car loans. Many people have been able to negotiate a lower interest rate on their car loans. This results in a lower monthly payment.

* Other unsecured loans. You can re-negotiate better terms with these lenders or just stop paying them altogether. Thinking about a short sale?

Loudoun to Winchester VA – The next step in the process of getting a cleaned up credit report, is the one that takes the least effort, but the most patience: WAITING.

You’ve done your part to get the ball rolling, and now the credit reporting companies have to do their part.

What happens during this phase is that the credit reporting agencies have 30 days to investigate.

I use the term loosely here because the methodology that they use is not very investigatory. They take the claims and whittle the dispute down to a 2 digit code that gets checked against a reporting database called eOscar for verification.

They are afforded 30 days to do this step, unless the person disputing has gotten their credit report from annualcreditreport.com which allows them to take 45 days to check out your dispute (remember back in an earlier step where this was discussed – this isn’t the site to get your credit from!.)

While you wait, remember that whatever your credit score was before you began this process, you should be doing things now to improve it.

What I mean by this is that while waiting for the history part of your credit report to be cleaned up, you work on the future of the credit report. Take action now to build a better situation.

First, keep your report clean from this moment forward. Don’t tarnish it beginning now. Do not have a single late payment – pay your bills on time.

I know, it’s easier said than done, but it will be important in your future that you did this today. Don’t have any new collection accounts or charge offs.

Don’t, REALLY don’t, get new inquiries on your credit report – this means don’t open any new credit cards, store charge cards. No applying for everything that sounds like a good idea.

Don’t close any open credit cards. Pay off the credit card - yes, but close out the account – no. Keep this length of history long on your report.

And, just wait. The 30 days for the credit bureau investigation will fly by. Once their 30 days is up, they have 5 additional days to provide you with their findings.

If anything in their investigation was not verifiable, that item is required to be removed from your credit report. They will also send you an updated credit report.

So, watch for their letter to you in your mailbox after you complete the WAITING step.
